 Scope and Precedence

These Policies apply to all current and future products and services offered by Active Pivot. If a product or checkout page explicitly states different terms for that specific offering, those product-specific terms will govern for that purchase. Nothing in these Policies limits any non-waivable consumer rights under applicable law.

 

1) TOSTerms of Service

1.1 Eligibility & Use

By accessing our website, purchasing our products, or using our services, you agree to these Policies and any product-specific terms on the relevant product/checkout page. You represent that you are legally able to enter into contracts in your jurisdiction and that you will use our offerings lawfully and as intended.

1.2 Accounts, Communications, and Contact

You may receive transactional emails (order confirmations, access/delivery, intake requests) and service notifications. You can unsubscribe from marketing emails at any time; transactional emails related to your purchases will still be sent. You are responsible for ensuring your email address is accurate and accessible. If you are receiving Active Pivot’s email for the first time, please add it to your contacts, to avoid landing in your SPAM box.

1.3 Overview of Offerings

- Digital products: e.g., “How Your Unique Story Can Get You Hired” eBook, Whitepapers, and Market/Industry Reports.
- Services: e.g., LinkedIn Profile Optimization (LPO) and Professional Resume Review (PRR).
- Subscriptions/Credit-based programs: e.g., LinkedIn Content Mastery (LCM) and Career Accelerator Program (CAP).
- Mentorship program: email-only mentorship guiding you through the 7Cs pivot framework (see Section 2.5).

1.4 Orders, Pricing, and Payment

Prices are listed in USD. Taxes or processing fees may apply. Payments are processed by third-party payment providers. For subscriptions/credits, billing recurs until canceled, subject to the plan terms on the product page.

1.5 Delivery & Intake

- Digital products: Instant access via on-screen link and/or email after successful payment.
- Services (LPO/PRR): Work commences only after we receive a complete intake (questionnaire and required materials). Delivery timelines start after complete submission.
- Mentorship program: After purchase, you will receive a link by email to a comprehensive question set. The program is email-only (no 1-to-1 live sessions).

1.6 Review Window (Services)

For services (LPO/PRR), you have a 7-day window after delivery to request factual corrections/clarifications based on your submitted information. This window does not cover scope changes, rewrites, or new deliverables.

1.7 Acceptable Use

You agree not to misuse our materials or services, including by sharing proprietary content without permission, scraping, reverse engineering, infringing intellectual property rights, or violating applicable laws.

1.8 Intellectual Property

All content, templates, frameworks (including the 7Cs framework), and deliverables are owned by Active Pivot or its licensors. For digital products, you receive a personal, non-transferable license for your own use. Resale, redistribution, or public posting is prohibited unless explicitly authorized.

1.9 No Guarantees; Limitation of Liability

Our materials and services provide guidance and education; outcomes such as interviews, job offers, or business results are not guaranteed. To the maximum extent permitted by law, our aggregate liability for any claim relating to a purchase is limited to the amount you paid for that specific product or service.

 

2) Refunds & Cancellations

2.1 Global Applicability & Precedence

This Refund Policy applies to all Active Pivot products and services unless a product/checkout page explicitly states different terms. If there is any inconsistency, the product-specific terms shown on the product and/or checkout page will govern for that purchase.

2.2 Digital Products (eBook, Whitepapers, Market/Industry Reports)

- All sales are final once access is provided (e.g., download link displayed or emailed). No refunds for digital downloads.
- We will assist with access issues or file corruption. If we cannot provide access within 72 hours due to a technical fault on our side, we will replace the file or provide an alternative access method.

2.3 Services (LPO, PRR)

- Work begins only after we receive a complete intake. If a complete intake is not provided within [14] days of purchase, we may cancel and refund the full amount, at our discretion.
- Once work has begun (e.g., research, analysis, drafting, examples prepared, or any portion delivered), refunds are not available.
- Delivery target: typically 3–7 business days after complete intake (see product page for specifics). If we miss delivery without a client-caused delay, you may request a refund.
- Review window: 7 days after delivery for factual corrections/clarifications based on your intake; this is not for rewrites or scope changes.

2.4 Subscriptions/Credits (LCM, CAP)

- Billing recurs until canceled. You can cancel anytime to stop future renewals; the current billing period is non-refundable.
- Credits/packages expire at the end of the stated term if unused, unless the product page states otherwise.
- Once the first credit is used or the cycle begins, the current period is non-refundable.

2.5 Mentorship Program (Email-Only; 7Cs Framework Guidance)

Mentorship Scope Clarification: This mentorship program is designed to guide you through the 7Cs pivot framework (corresponding to our ebook “The 7Cs To Pivot Like A Pro”). We will address questions related to career transitions, personal development, and professional growth as they connect to the 7Cs. We do not provide specialized technical training, legal or financial advice, therapy, or counseling services. The program is conducted via email only; there are no 1-to-1 live sessions.

- Intake: After purchase, you must complete a comprehensive question set sent to you by email. Work starts only after we receive your completed responses. If a complete intake is not provided within [14] days, we may cancel and refund full amount, at our discretion.

- Plan types: (a) Ad-hoc (pay per email); (b) Half-yearly (8 emails per 6 months); (c) Annual (18 emails per 12 months).

- Definition of an "email": One incoming email from you focused on a single topic or question, and our corresponding response. Follow-ups or new topics may consume additional email credits.

- Response time: We aim to respond within 3 business days per email. Response times may vary based on queue and complexity.

- Expiration and rollover: Half-yearly plan credits must be used within the 6-month term; annual plan credits within 12 months. Unused credits expire at term end and do not roll over unless expressly stated on the product page.

- Refunds:
• Ad-hoc: Non-refundable once our response is delivered.
• Half-yearly/Annual: The current term is non-refundable once the first response is delivered or after [7] days from purchase, whichever occurs first. You may cancel to prevent future renewal (if applicable).

2.6 Bundles, Order Bumps, Upsells, Downsells

- Digital components are non-refundable once provided. Service components follow the Services rules above.
- No partial refunds after any included digital component has been delivered.

2.7 Chargebacks & Disputes

Please contact support@active-pivot.com first to resolve any issue. Unauthorized chargebacks may result in account suspension and voided affiliate commissions. We may require documentation to investigate claims.

2.8 How to Request a Refund or Cancellation

Email support@active-pivot.com from your purchase email address with your order ID, product name, the email address you purchased the product/service with, and reason. We may need additional information to verify your identity and order. Approved refunds will be processed to the original payment method where possible.

2.9 Product-Specific Exceptions Schedule

Any product-specific variations (e.g., extended intake window, alternate SLA, special launch terms) will be listed on the relevant product or checkout page and will govern for that purchase.

3) Affiliate Program Terms

 

3.1 Enrollment

We may approve or deny affiliate applications at our discretion. Affiliates must comply with these terms and applicable laws and guidelines (including FTC disclosure requirements).

 

3.2 Commissions and Attribution Commission rates:

Front‑end products (eBooks) 50%; Order Bumps (if available) 30%; Upsells/Downsells/Services 20%; Default commission for other eligible offers (e.g., whitepapers, courses, mentorship) 30%. Qualifying Net Sales: Excludes taxes, shipping, discounts, payment‑processor fees, refunds, and chargebacks. Cookie window: 45 days. Attribution: Last non‑self affiliate click before purchase is credited (“last‑click wins”). Overwrites: Direct visits and our own non‑affiliate links do not overwrite an existing affiliate cookie; cross‑device/cross‑browser tracking is not guaranteed; cleared cookies or purchases after 45 days are not credited. Non‑commissionable: Taxes/fees, refunded/charged‑back transactions, unapproved coupons, self‑referrals, fraudulent or abusive activity.

 

3.3 Payouts Schedule:

Net‑45 from the transaction date. Method: PayPal or bank transfer (affiliate must provide accurate payout details). Currency: USD by default; if paid in another currency, FX conversion is per the payment provider’s rate. Minimum payout threshold: $45; unpaid balances roll over to the next cycle. Fees: Payouts are made net of third‑party fees. PayPal, bank/transfer, intermediary‑bank, and currency‑conversion fees may be deducted from the payout. We are not responsible for delays or losses due to incorrect payout details.

 

3.4 Locking Period and Reversals Locking:

Commissions lock Net‑45 from the transaction date to allow for refunds/chargebacks. Reversals: Refunded, disputed, or fraudulent transactions are reversed.

 

3.5 Transparency

We will email a payout summary each cycle showing gross commissions, reversals, subtotal, fees we deducted (processor/bank/FX), the net amount sent, and the transaction ID. PayPal may display its own conversion rate on the recipient side; bank transfers may incur intermediary/receiving‑bank fees that we cannot itemize.

 

3.6 Promotion & Traffic Rules

No paid search on our brand names or typos; no spam or misleading claims (including income promises). No coupon/discount promotions beyond codes we issue or approve. Email and social promotions must comply with platform policies and anti‑spam laws. We may require removal of any placement we deem misleading or non‑compliant and may suspend/terminate accounts for violations.

 

3.7 Eligibility, Taxes, and Changes

We may approve, suspend, or terminate affiliate accounts at our discretion for policy violations or fraudulent activity. Affiliates are responsible for any required tax forms and for reporting/paying their own taxes on commission income. We may update rates/terms with notice; changes apply prospectively to new transactions only.

3.8 Termination

We may suspend or terminate participation at any time for violation of these terms or suspected fraud. Unpaid invalid commissions will be voided. The affiliate relationship is that of an independent contractor.

 

4) Privacy Policy

 

4.1 Data Controller & Contact

Active Pivot is the data controller for personal data processed in connection with our offerings. Contact: support@active-pivot.com

4.2 Information We Collect

- Identity and contact data (e.g., name, email, company).
- Transactional data (orders, amounts, product details).
- Content you submit (e.g., resumes, LinkedIn URLs, mentorship intake answers).
- Technical data (IP address, device/browser, pages viewed).
- Marketing and attribution data (cookies, UTMs, affiliate IDs).

4.3 How We Use Information

- To process orders, deliver products/services, and provide support.
- To send transactional messages (access, receipts, intake, delivery).
- To send marketing communications where permitted/consented; you can unsubscribe anytime.
- To improve our offerings, security, and fraud prevention.
- To comply with legal obligations.

4.4 Legal Bases (where applicable)

- Contract performance (to deliver purchases).
- Consent (for marketing communications and certain analytics).
- Legitimate interests (to operate, secure, and improve our services).
- Legal compliance.

4.5 Sharing with Service Providers

We use trusted third parties to operate our business, including but not limited to: Systeme.io (funnels and transactional email), Blastable (email marketing), Albato (automation/webhooks), payment processors (e.g., Stripe/PayPal), analytics/anti-spam tools, hosting and security providers. These providers process data on our behalf under appropriate safeguards.

4.6 Data Retention

We retain data for as long as necessary to provide services, comply with legal obligations, resolve disputes, and enforce agreements. Retention periods may vary by data type and legal requirement.

4.7 International Transfers

Your information may be transferred to and processed in countries outside your own. Where required, we implement appropriate safeguards for such transfers.

4.8 Security

We use reasonable technical and organizational measures to protect personal data. No method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

4.9 Your Rights

Subject to applicable law, you may have rights to access, correct, delete, or restrict processing of your personal data, and to object or withdraw consent for marketing. Contact support@active-pivot.com to exercise your rights.

4.10 Marketing Choices

You can unsubscribe from marketing emails at any time via the link in our emails. You will still receive essential transactional messages related to purchases.

4.11 Children’s Privacy

Our offerings are not directed to children. We do not knowingly collect personal data from children. If you believe a child has provided personal data to us, please contact us.

 

5) Cookies & Similar Technologies

We use cookies and similar technologies to enable site functionality, analyze usage, remember preferences, and support marketing attribution. You can control cookies through your browser settings; disabling cookies may affect site functionality. Where required, we will request consent for non-essential cookies.

6) Disclaimers

- Educational and informational purposes: Our materials, services, and mentorship provide guidance and frameworks; they do not constitute professional legal, financial, or therapeutic advice.
- No guarantees of results: Outcomes such as interviews, offers, revenue, or business performance are not guaranteed. Results vary based on many factors outside our control.

7) Changes to These Policies

We may update these Policies from time to time. The Effective Date above reflects the latest revision. Material changes will be noted on this page. Your continued use of our offerings after changes become effective constitutes acceptance of the updated Policies.
